This website offers visitors purchase of art by Sonya Jane and Cliff Woodward. By using this Site, you indicate that you have read and understand the Terms and Conditions and agree to always abide by them.

To use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

Intellectual Property: All content published and made available on our Site is the property of FramebyFrame1 and the Site’s creators. This includes, but is not limited to images, text logos, documents, downloadable files, and anything that contributes to the composition of our Site.

Copyright in the Artwork: Remains the property of the Artist. You may not produce any image of the Artwork and may not, at any time, publish or submit for publication or reproduction any image of the Artwork to any third party, including any internet website for any purpose.

Acceptable Use: As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to; violate the intellectual property rights of the Site owners and any third party to the Site; or Hack into the account of another user of the Site.

If we believe you are using our Site illegally or in a manner that violate these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site.

Changes: All information, descriptions, or images that we provide about our goods and services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods and services we provide. You agree to purchase goods and services from our Site at your risk.

The Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes in the way we operate our Site and the way we expect users to behave on our Site. We will either notify users by email of changes to these Terms and Conditions or post a notice on our Site.

Pricing: We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing is available on the Payments page.

Payment: When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibly to monitor your payment to verify receipt of any refund.

Refunds and Services: Your satisfaction and happiness are important to us. Simply return it undamaged with any included accessories and packaging along with the original receipt within 14 days of the date you receive the product.  We will exchange it or provide a refund (please note this does not include any non-refundable deposits, such as in the case of Commissioned Art).

In addition, please note the following: (i) Products can be returned only to the country in which they were originally purchased; and (ii) artworks are not eligible for return unless agreement has been made with the artist and the return of the artwork will be paid for by the purchaser; (iii) Return shipping is the responsibility of the purchaser. Shipping and Delivery: When you purchase goods from our Site, the goods will be delivered by standard delivery by post or Courier. Delivery takes, normally 5-14 business days within Regional Australia and International orders take longer.

Delivery will take place as soon as reasonably practicable, depending on the delivery method selected. Delivery times may vary due to unforeseen circumstances, delivery times do not include weekends and public holidays.

You will be required to pay delivery charges in addition to the price for the goods you purchase.

If you purchase goods from us for delivery to a destination outside of Australia your purchase may be subject to import duties, and taxes applied by the destination country. You are responsible for paying any such duties or taxes. We are not responsible for the payment of any such duties or taxes and are not liable for any failure by you to pay them.

Consumer Protection Law: Where the Australian Consumer Law, Schedule 2 of the Competition and Consumer Act 2010, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Links to Other Websites: Our Site contains links to third party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third-party website of service linked to our Site. It is your responsibility to read the Terms and Conditions and privacy policies of these third-party websites before using these sites.

Limitation of Liability: FramebyFrame1 and our Artists, agents, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, and expenses including legal fees from your use of the Site.

Indemnity: Except, where prohibited by law, by using the Site you indemnify and hold harmless FramebyFrame1, and our Artist, agents, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities, and expenses including, legal fees arising out of your uses of our Site or your violation of these Terms and Conditions.

Application Law: These Terms and Conditions are governed by the laws of Australia and the Australian Capital Territory.

Severability: If at any time of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and rest of these Terms and Conditions will still be considered valid.

FramebyFrame1, collects and stores any information accompanying your use of our website or provide us in any other way. FramebyFrame1 is hosted by WordPress/Plesk platform and WordPress/Woo Commerce provides us with the online platform that allows us to sell our products and services to you.

While we take all reasonable precautions to ensure that user data is secure and that users are protected, there always remains the risk of harm. The Internet can be insecure at times therefore, we are unable to guarantee the security of user data beyond what is reasonably practicable.

We may get in touch regarding your account-related information, troubleshoot any issues with your account, resolve a dispute, collect fees or money owed, send you FramebyFrame1 updates, or as otherwise required to get in touch with you to enforce our User Agreement, applicable local laws, and any other agreements we might have with you.
